These Terms and Conditions (“Terms”) govern your use of valet parking services provided by Open Door Valet LLC (“ODV,” “we,” “our,” or “us”). By using our valet services, you agree to be bound by these Terms.
1. Acceptance of Terms
By handing your vehicle keys to our valet attendant, confirming your valet ticket, or otherwise utilizing our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
2. Service Description
Open Door Valet provides professional valet parking services at various venues including restaurants, hotels, events, and private residences. Our services include:
- Professional parking and retrieval of your vehicle
- Secure key storage during your visit
- Digital ticket tracking and notifications
- Vehicle status updates via SMS (with consent)
3. Customer Responsibilities
As a customer, you agree to:
- Remove Valuables: Remove all valuables, electronics, cash, and personal items from your vehicle before valet service. We are not responsible for items left in vehicles.
- Report Pre-Existing Damage: Inform our attendant of any pre-existing damage or mechanical issues before parking.
- Retain Your Ticket: Keep your valet ticket or digital confirmation. It is required to retrieve your vehicle.
- Timely Retrieval: Retrieve your vehicle within the venue's operating hours unless overnight parking is arranged.
- Accurate Information: Provide accurate contact information for vehicle status notifications.
4. Liability Limitations
What We Are NOT Responsible For:
- Vehicle Contents: Loss, theft, or damage to any items left inside the vehicle, including but not limited to cash, jewelry, electronics, documents, or personal belongings.
- Pre-Existing Conditions: Any damage, defects, or mechanical issues that existed prior to valet service and were not reported to our attendant.
- Mechanical Failures: Engine problems, tire blowouts, brake failures, or other mechanical issues not caused by our handling.
- Acts of Nature: Damage caused by weather events, falling objects, acts of God, or circumstances beyond our control.
- Third-Party Actions: Damage caused by other vehicles, vandalism, or criminal acts while parked.
- Consequential Damages: Lost profits, lost time, rental car costs, or other indirect damages.
What We ARE Responsible For:
- Proven Negligence: Damage directly and provably caused by the negligent actions of our valet attendants while operating your vehicle.
Maximum Liability: Our liability is limited to the actual cost of repair for proven damage caused by our negligence, not to exceed the fair market value of the vehicle, and subject to our insurance policy terms.
5. Damage Claims
If you believe your vehicle was damaged during valet service:
- Report Immediately: All damage claims must be reported to valet management before leaving the premises. Claims made after departure cannot be honored.
- Documentation: We will document the claim with photos and a written incident report.
- Investigation: All claims are subject to investigation and review of our records.
- Resolution: Valid claims will be processed through our commercial insurance carrier.
6. Insurance Coverage
Open Door Valet maintains commercial garage liability insurance that covers:
- Physical damage to customer vehicles caused by our proven negligence
- General liability for our operations
This insurance does NOT cover personal belongings, pre-existing damage, or mechanical failures. Your personal auto insurance remains your primary coverage for comprehensive claims.
7. Fees & Payment
- Service Fees: Valet fees are determined by the venue and posted at the valet stand. Some venues offer complimentary valet service.
- Payment Methods: We accept cash, credit cards, and digital payments where available.
- Gratuity: Tips are not included in service fees and are at your discretion. Gratuities go directly to your valet attendant.
- No Refunds: Valet service fees are non-refundable once service has been rendered.
8. Lost Ticket Policy
If you lose your valet ticket:
- Valid government-issued photo ID is required
- Vehicle registration or proof of ownership may be required
- An administrative fee of up to $25 may apply
- Additional wait time may be necessary to verify ownership
9. SMS & Communication Consent
By providing your phone number, you consent to receive:
- Vehicle status updates (parked, requested, ready)
- Digital ticket confirmations
- Service-related notifications
Message and data rates may apply. You may opt out at any time by replying STOP to any message. See our Privacy Policy for details on how we handle your information.
10. Overnight & Extended Parking
- Overnight parking must be pre-arranged with venue management
- Additional daily storage fees may apply
- Vehicles left beyond 24 hours without arrangement may be towed at owner's expense
- ODV is not responsible for vehicles left overnight without prior arrangement
11. Prohibited Items & Vehicles
We reserve the right to refuse service for vehicles containing:
- Illegal substances or contraband
- Unsecured weapons or firearms
- Hazardous materials
- Live animals left unattended
We may also refuse service to vehicles that are unsafe to operate or excessively modified.
12. Indemnification
You agree to indemnify, defend, and hold harmless Open Door Valet, its officers, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your breach of these Terms
- Your misrepresentation regarding vehicle condition or ownership
- Claims by third parties related to items left in your vehicle
13. Dispute Resolution
Any disputes arising from these Terms or our services shall be resolved through:
- Informal Resolution: Contact us first to attempt to resolve the issue directly
- Mediation: If informal resolution fails, parties agree to attempt mediation
- Governing Law: These Terms are governed by the laws of the State of New Jersey
- Jurisdiction: Any legal proceedings shall be brought in the courts of Mercer County, New Jersey
14. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any modifications constitutes acceptance of the updated Terms.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
